Appointment of Arbitrator without specific clause of Arbitration - NBCC Case

According to the provisions of the Arbitration and Conciliation Act, 1996, (‘the Act’), an Arbitration Agreement may be entered into through reference, i.e. reference to a document which contains an arbitration clause. It means that that the arbitration clause is included in the other contract as well provided the contract is in writing and the reference is such as to make the arbitration clause part of that contract.
